Terms of Service
1. Who we are and what these terms cover
Trivia Night (the “Service”) is operated by Soalverse, a registered business in Ontario, Canada (“Soalverse”, “we”, “us”). The Service includes the website at trivia.soalverse.ca, the live trivia game (as host, player or spectator), the audience display, and the demo.
These Terms of Service (the “Terms”) are a legal agreement between you and Soalverse. By visiting or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.
If you or your organization has a separate written agreement with Soalverse (for example, to run a hosted event or receive custom question sets), that agreement governs that engagement. If it conflicts with these Terms, the written agreement wins.
2. Who can use the Service
The Service is intended for people who are 13 years of age or older. It is not directed to children under 13, and our public question sets are written for teen and adult audiences. If you are under the age of majority where you live, you may use the Service only with the involvement and permission of a parent, guardian, teacher or event organizer who agrees to these Terms on your behalf.
3. How the Service works
You don’t need an account. A host starts a game and shares a game code; players join with a display name of their choosing, and spectators can watch. Your display name, emoji, answers, scores and chat messages are visible to the host and to the other players and spectators in that game, and may be shown on a big screen at an event. Please don’t use your full name or share personal information you don’t want others in the room to see.
The demo runs entirely in your browser with simulated players. Nothing you enter in the demo is sent to us.
4. Acceptable use
You agree not to:
- choose a display name, team name or chat message that is hateful, harassing, threatening, sexually explicit, discriminatory or otherwise offensive, or that impersonates someone else;
- share another person’s personal information without their permission;
- cheat, or interfere with a game or the Service, including by using scripts or bots, flooding answers or messages, tampering with scores, or attempting to access games, data or systems you aren’t authorized to access;
- probe, scan, overload, reverse engineer or disrupt the Service or its infrastructure, except as permitted by law;
- copy, scrape or republish our question sets or other content, or use the Service to build a competing product;
- use the Service for anything unlawful, or to upload content you don’t have the right to use.
Hosts can remove players from a game, and we may remove content or restrict access if we believe these Terms have been broken.
5. Your content
“Your content” means anything you enter into the Service, such as display names, team names, chat messages, answers and question sets a host uploads. You keep whatever rights you have in your content. You give Soalverse a non-exclusive, worldwide, royalty-free licence to host, store, display and transmit your content only as needed to operate the game you’re part of and to keep the Service safe. You confirm that you have the right to share your content and that it follows these Terms.
Game data is temporary. It is removed when a host closes the game, as described in our Privacy Policy, so don’t rely on the Service to keep a copy of anything.
6. Our content and intellectual property
The Service, including its software, design, graphics, sounds, text and question sets, is owned by Soalverse or its licensors and is protected by copyright, trademark and other laws. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable permission to access and use the Service as it is made available to you. No other rights are granted. “Soalverse” and our logos may not be used without our written permission.
7. Hosts and events
If you host a game, you are responsible for how your event is run, for any question sets you upload, and for making sure your participants understand that their names and messages will be visible to the room. If you host on behalf of an organization, you confirm that you have authority to do so. Commercial or paid use of the Service requires a separate written agreement with Soalverse.
8. Third-party services
The Service relies on third-party providers for things like hosting, real-time data and fonts (see our Privacy Policy). We aren’t responsible for third-party websites or services, and your use of them may be subject to their own terms.
9. Availability and changes
We are always improving the Service, so features may change, be added or be removed. We may suspend or discontinue all or part of the Service at any time, and a game may end unexpectedly because of network or technical issues. We don’t guarantee that the Service will be uninterrupted or error-free.
10. Disclaimers
The Service is provided for entertainment. We work hard on our questions, but we don’t guarantee that every question, answer or explanation is complete, accurate or current, and trivia content isn’t professional advice of any kind.
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties or conditions of any kind, whether express or implied, including implied warranties or conditions of merchantable quality, fitness for a particular purpose and non-infringement.
Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived or limited by contract, including Ontario’s Consumer Protection Act.
11. Limitation of liability
To the fullest extent permitted by law, Soalverse and its owners, contractors and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or revenue, arising out of or related to your use of (or inability to use) the Service, even if we were told such damages were possible.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Service or these Terms is limited to the greater of (a) the amount you paid Soalverse to use the Service in the 12 months before the claim arose, or (b) CAD $100.
Some jurisdictions don’t allow certain exclusions or limitations, so some of the above may not apply to you. These limits don’t apply to liability that cannot be limited by law.
12. Suspension and termination
You can stop using the Service at any time. We may suspend or end your access to a game or to the Service if you break these Terms, if we’re required to by law, or to protect other users or the Service. Sections that by their nature should continue (including sections 5, 6, 10, 11 and 13) survive after your use ends.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You and Soalverse agree to the jurisdiction of the courts located in Ontario, except where the law where you live gives you the right to bring a claim in your local courts or under your local laws.
14. Changes to these terms
We may update these Terms from time to time. When we do, we’ll change the “Last updated” date above, and if the changes are significant we’ll make reasonable efforts to point them out on the Service. Changes apply from the date they are posted. If you keep using the Service after that, you accept the updated Terms.
If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision isn’t a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and Soalverse about the Service, except where a separate written agreement applies.
